WHEELER ENTERTAINMENTS TERMS AND CONDITIONS

 

 

Terms and conditions of Wheeler Entertainments (Glasgow) and the client (herein known as the ”Venue").

Any booking made with Wheeler Entertainments will be a legally binding contract subject to the following non-negotiable terms and conditions:

 

Services

 

- Wheeler Entertainments will manage the booking of regular live entertainment. Wheeler Entertainments will refer and schedule live entertainment based on The Venue's budget and live music requirements.

 

 

-     Under these Terms and Conditions Wheeler Entertainments is allowed to book any Artists/Performers/DJ’s/Musicians and their substitutes required to fulfil the above services to the highest standards of the Venue. All Artists/Performers/DJ’s/Musicians booked will herein be known as the “Artist."

  

Artist

 

-     The artists will not be legally signed by, or be an employee of Wheeler Entertainments. Wheeler Entertainments does not accept any responsibility over The Artist's registration of employment.

-     Wheeler Entertainments does not have any responsibility for the health, safety and well-being of The Artist while they are at The Venue, however will take any reports of an Artist feeling unsafe at The Venue with serious consideration to prevent such events happening again.

-     After an Artist is booked in the Venue by Wheeler Entertainments, all repeat bookings of this artist must be made exclusively by Wheeler Entertainments for the duration of this agreement and 6 (SIX) months after the termination of Wheeler Entertainments booking services. Any attempt to re-book an Artist within this period will be charged at Wheeler Entertainments standard fee. 

-     The Artist will be entitled to free water or soft drinks. Soft beverages should be made available during Artist arrival times and between performances.

-     An hour of booked time for all Artists will comprise of a maximum 45 (FORTY-FIVE) minutes performance and a minimum 15 (FIFTEEN) minutes break. This is to ensure the health and safety of all Artists and prevent prolonged vocal related injuries for those applicable.

-    Artists will perform for a maximum of 4 (FOUR) hours per performance including breaks.

-     The Artist will conduct the Performance in such a manner so as not to breach any law and will not cause the Venue to breach any of the conditions of the permits or consents that the Venue or the Artist have obtained (the Venue must notify Wheeler Entertainments of any and all performance limiting factors – i.e. decibel limiters, residential neighbours, early curfews, expired PRS license, etc.).

-     The Venue may record and/or film, or arrange for the recording and/or filming of the Performance.     

-      The Venue acknowledges that if the Artist is late or absent from an event without prior warning, Wheeler Entertainments will not be held responsible for this absence, however Wheeler Entertainments will make best efforts to find a suitable replacement. No booking charges will be made by Wheeler Entertainments if a suitable replacement cannot be found.  (Any pre-paid performance fees will be refunded to the venue within 7 (seven) days of non-performances).

 

Promotion

 

-     The Venue may use the Artist's name and approved photographs, likenesses and biographies to advertise and promote the show.

 

Payment

 

-      Wheeler Entertainments does not have authorisation to approve any Artist Fee's on behalf of The Venue unless authorised from an appropriate manager from The Venue. The Artist will perform for no less than £100 per player Sundays-Thursdays and £120 per player on Fridays and Saturdays. Wheeler Entertainments recommends referring to The Musicians Union for acceptable Artist fees: http://musiciansunion.org.uk/. 

-           The Artist will be paid a full amount for their gig by the Venue within 14 (FOURTEEN) days of either their performance or submission of invoice if applicable, unless otherwise agreed. 

-     Wheeler Entertainments will be paid within 1 (ONE) calendar month of submitting their invoice. Any attempts to appeal Wheeler Entertainments'  fees or question an invoice must be made within this month.

-     Any late payments will be a conflict of these terms and conditions and can lead to the instant cancellation of all booked entertainment in The Venue and further legal action if necessary.

-     Wheeler Entertainments will not traffic any payments to an Artist unless otherwise agreed.

-     Wheeler Entertainments does not accept responsibility for an Artist's Tax or NI.

 

Changes/Cancellations  

 

-    Wheeler Entertainments is not responsible for paying Artists fee in event of Venue cancellation. The Artist will charge standard booking fee for any cancellation made within 48 (FOURTY EIGHT) hours of the event by The Venue. For guidelines as to appropriate cancellation periods Wheeler Entertainments recommends referring to The Musicians Union: http://musiciansunion.org.uk/

-    Wheeler Entertainments will charge standard booking fee for any cancellation made within 48 (FORTY EIGHT) hours of the event by The Venue.

-    Wheeler Entertainments will be responsible for paying The Artist not performing in the event of a double booking caused by Wheeler Entertainments. 

-      If The Artist notifies Wheeler Entertainments within 48 (FORTY-EIGHT) hours of the event that they cannot perform, Wheeler Entertainments will make best attempts to find a replacement act within the timeframe but will not be held responsible if they cannot do so. However the Venue will be notified of all updates and any non-performances will be deducted from both The Artist and Wheeler Entertainments fees accordingly.

-     The Venue/Wheeler Entertainments may act against these terms and conditions immediately, without any notice to the Artist if any member of the Artist commits any act of serious misconduct, including but not limited to:

     (i) Any act of fraud or dishonesty;

     (ii) Any act which may injure or endanger any other person; or

     (iii) Any act which may directly or indirectly damage the reputation of the Venue

     (iv) Any force majeure event or “act of god” including, but not limited to: pandemic, Government ordered closures, flooding, electrical storm, terrorist attack or warning, state of emergency, war, riots, earthquake, volcanic eruption, hurricane etc. that prohibits the artist from safely travelling to the venue, or the safe operation of the venue and resulting performances will result in all fees being waived and performance(s) cancelled.

 

Equipment 

 

-     The Venue will inform Wheeler Entertainments of available equipment before any bookings. The Artist will supply any remaining equipment required to perform the event.

 

Instrument/s

 

-     All Artists will ensure their equipment is well maintained. If an Artist has broken equipment or fails to supply appropriate equipment in order to successfully perform, they will not be paid for that event. Additionally, Wheeler Entertainments costs will be waived. If the equipment is replaced/fixed in time to play the agreed set (or start and finish their set late at Venue’s discretion), the Artist and Wheeler Entertainments will be paid as agreed.

-     If The Venue fails to supply the initially agreed equipment in full working order and The Artist is therefore unable to perform, the event will be cancelled and an Artist will be paid the agreed fee without deduction. Additionally Wheeler Entertainments will charge the agreed rate.

-           If requested, the venue must provide covering sheets for any and all requested documentation, including but not limited to – public liability insurance, employers liability insurance, PRS for music certificate.
